We will provide a professionally decorated dessert in a timely manner as specified in the invoice or contract. We appreciate your business and we are honored that you have chosen us for your special celebration. We guarantee that the flavors, size, and general design elements will be met as outlined. The design and color may vary from the ones shown in the product pictures due to dietary restrictions and the availability of ingredients.
Allergy Disclaimer
Please be aware that all ingredients are processed on the same equipment (eggs, soy, wheat, nuts, coconut etc.). Although we have strict processes in place to prevent cross-contact there is still a slight risk of the presence of any allergen. We shall not be held responsible for any health-related or any other issues and you agree to it.
COVID-19 and any other Viruses
We are taking extra care of our personal hygiene and all of the family members. We have a separate room for storing all baking ingredients and we are doing our best to ensure we have following all guidelines given by CDC and the US government. Just like everything else we do for our household items, we ensure all the ingredients are properly cleaned and stored away in containers. Our kitchen surfaces are cleaned and sanitized daily, and we have increased the frequency of cleaning and disinfecting all areas. We do contactless pickup and delivery ONLY. You will tell us 5 min before reaching our house and we will keep the cake outside so you can pick it up conveniently. The customer will not hold Akki’s Cupcakery & Tea liable for any damages due to COVID-19 or any other virus that can affect them or anyone who eats our baked products.
General Information
Akki’s Cupcakery & Tea respects the privacy of our customers, business partners, employees, and job applicants and other visitors to our websites who may choose to provide personal information. We recognize the need for appropriate protection and management of the personal information that you provide to us. This Terms of Service and Privacy Statement will assist you in understanding what types of information we may collect, how that information may be used, and with whom the information may be shared. Any order placed over the website, mobile app, phone or in-person accepts these terms of use. Also, any payments made on Venmo, Zelle, CashApp, Credit Cards, Cash etc. also accept these terms of use.
Care and Handling
We are not responsible for any damage to the dessert after pick-up or after setup is complete. The client is responsible for providing an appropriate and secure table and environment for the dessert(s). Desserts(including cakes) are heavy and require a sturdy table and optimal room temperature of 75 degrees or below.
If you or your representative elects to pick up and set up the dessert, you assume all liability and responsibility for the condition of the cake once it leaves the possession of Out of Akki’s Cupcakery & Tea.
- In the case of fresh flower usage on the cake, the responsibility of the flower safety and safe food practices will rest with the florist and not with Akki’s Cupcakery & Tea. The person placing this order should obtain a notice of plant safety, in question, from the florist.
- Once out of the Akki’s Cupcakery & Tea location, we are not responsible for any damage to the dessert(s) caused by the placement of flowers by another party or other items on the desserts.
Photographs and Marketing
We respect the privacy of all our clients. We will not disclose the identity of clients (photographs of people, last names, event details, contact details) without permission. We do, however, reserve the right to photograph baked goods and use those photos on our website, social media, or marketing materials. We also reserve the right to use any photographs for display or promotion without compensation to you.
Decorations and Coloring
We have highly skilled decorators. We will do our best to match any requested color or design. We are limited to the fact that we are dealing with icing that can fade due to light and temperature so we do not guarantee an exact match. Also, due to the nature of drawings, we will make our best representation of what is requested but are again limited by the nature of our product.
Shipping
We offer FREE PICKUP and Local Delivery in San Antonio. The shipping cost shall be calculated based on your shipping We are located at 16131 Salto Del Agua 78255 at checkout.
Delivery
If a delivery is requested, we will not be held responsible for any damages during the delivery or any other issues related to the baked goods. We reserve the right to postpone delivery due to inclement weather or national emergencies/lockdowns. We will postpone delivery to the next available safe day for our team. On days schools are closed or delayed we may shift delivery windows to ensure the safety of our team. If we are not able to deliver for more than 3-5 days then we offer a Gift Card refund based on the request from our Client. If the client wishes to pick it up, then the shipping charged will be refunded to the original method of payment.
The Client must disclose any adverse road hazards and/or obstacles that may hamper the delivery and quality of finished products. In the case of an unavoidable occurrence, such as an act of god, a car accident, poor road conditions, or dropping off baked goods during delivery — Akki’s Cupcakery & Tea shall not be held liable for more than the price of the cake described in this order as per our refund policy.
Edible Images and Copyrights
Image editing
- We do not offer touch up or color adjustments. Minor cropping may occur in order to fit the image to cake or dessert/space available.
Copyright
- Copyright images will not be printed. In order for copyright images to be reproduced, authoritative letters from governing body to whom the image has been copyrighted will be requested and needed upon placement of order.
Intellectual property
- Customers should be informed that you can’t do exact replications if the designs requested are copyrighted.
- If you want to use photos of their cake for your portfolio, you should mention that here.
Additional Notes
- The image will be printed as on a “what is given” basis.
- Images are reproduced using edible ink food colors and therefore some distortion in the color from the original image is possible
- Edible image quality will depend on the image size and quality of the original photo provided
- Please bring in a copy of the image. We cannot guarantee the return of the image in the exact condition. If the image is lost or damaged we claim no responsibility for replacement or restoration of the original image.
Serving Size
- Define the size of each piece of cake and acknowledge that the amount of cake needed is an estimation and not guaranteed to be exact.
- You should not be held responsible if a cake shortage occurs because cake pieces are cut larger than the agreed-upon measurements.
When Ordering
All custom decorated orders are to be paid in full when the order is placed using online channels or over the phone. All online orders for In-Store pickup, delivery or shipping are paid in full when order is placed on our website or over the phone.
We will contact the customer by email, text or both (based on if we have the information) as soon as your order is ready. Any orders that are not picked up within 48 hours of the selected pickup date will be disposed or put on online giveaway by Akki’s Cupcakery & Tea and no refunds shall be provided.
Gluten-Free, Keto and Vegan Options
We do our best to create the best-baked products using mostly organic ingredients. We use the same kitchen for our products so cannot guarantee 100% gluten-free, Keto, or Vegan compliance, but are very close to that number. If you have any concerns then we request you not to order from us. Customer agrees to hold Akki’s Cupcakery & Tea harmless for any allergic reactions and to indemnify Akki’s Cupcakery & Tea in the event of any claims arising from allergic reactions.
Customer understands that Akki’s Cupcakery & Tea is not a gluten-free bakery. Akki’s Cupcakery & Tea uses best efforts when baking gluten free products including using separate equipment for gluten-free items. Akki’s Cupcakery & Tea cannot guarantee the absence of cross-contamination with gluten-containing products. If Customer or individuals who will taste the item Customer purchases from Akki’s Cupcakery & Tea has a gluten allergy, we recommend finding a bakery that is free from all wheat flours.
Out of Stock Policy
Our stock fluctuates throughout the day with sales demand and stock that we receive from vendors. If an item you ordered is out of stock, we will first try to contact the customer either by phone or via email. We will give you other comparable choices to choose from.
Refund/Exchange Policy
We take pride in our desserts and tea. If you are unhappy with your order and/or purchase, immediately notify us (within 24 hours of pick-up or delivery) of your concern and return your dessert to us. The dessert has to be returned to us, and in case more than half of the order of the dessert is finished, then we can’t provide any refund. No refunds on teas. We will give you credit for the amount based on the returned dessert towards a future purchase. The dessert has to be returned at our location. All refunds will be provided as a gift card i.e. Akki’s Cupcakery & Tea Gift Card within five (5) business days upon receipt of the returned merchandise. You must text the receipt @ 210.201.5669 of the purchase with you. The Gift cards are valid for 3 months from the date of issue.
What personal information does Akki’s Cupcakery & Tea collect?
Personal Information is information that can be used to identify or contact a specific individual, such as a name, address, telephone number or email address. We may collect certain personal information from customers, business partners, employees, and candidates for employment. akki@akkiscupcakery.com does not collect personal information when you visit our websites unless you choose to provide such personal information. No credit card information is stored on the Akki’s Cupcakery & Tea website. Credit card information that is given by phone is destroyed immediately after approval and processing.

Wedding & Grooms Cake Cancellation Policy
Wedding deposits are non-refundable & non-transferable (Deposit is deducted from the wedding cake balance only). Any Wedding or Groom’s cake orders canceled 2 weeks prior to your wedding date will receive only a 75% refund on any payments made after the deposit. Any Wedding or Groom’s cake orders canceled less than 1 week prior to your wedding date will receive no refunds on any payments made after the deposit.
Change Order
There will be a $15 Change Order fee for any changes that are requested within 24 hours of the time required.
Highly Decorated/Custom Cake Orders
Highly decorated cakes include wedding cakes, groom cakes, custom cakes, and cut-out cakes. We need 5-7 business days to cancel highly decorated/custom cakes. No refund will be provided if canceled within 5-7 business days as preparations are started, and we have allocated the time slot. During peak holiday season akki@akkiscupcakery.com reserves the right to adjust the cut-off date if orders have exceeded our production capabilities.
